How did the Arizona Supreme Court justify an 1864 abortion ban?
The legal reasoning, explained.
Last week, the Arizona Supreme Court ruled that the state must follow an 1864 law that prohibits all abortions except to save the life of the mother. The law makes no exceptions for rape or incest, and may impose prison time for doctors and patients ranging from two to five years. This essentially overrules the state’s current law, which allows for abortions up to 15 weeks.
