We now know that Trump's strategy to push all cases to SCOTUS is destined for success. That body, like Trump, will be known in the history books (if they're allowed to be written) as major
players in the deconstruction of the country that was America. I hold them in contempt exceeded only by Trump and his team of autocratic haters.
Thank you, Ms Wehle, for this clear, step by step, assessment of the decision and the controversy.
The facts we all have in the public space we share do point to your conclusions,
"The Chief Justice of the Supreme Court found that it is DOGE, an unconstitutionally established federal agency, that was at a greater risk of harm if it lost access to the secure and protected data at the SSA while Trump appeals than the American people whose data is at risk of breach. He reasoned that the DOGE team needs access to the records 'for those members to do their work.' ”
and
"In a dissenting opinion, Justice Ketanji Brown Jackson (joined by Justice Sonia Sotomayor) wrote that 'the ‘urgency’ underlying the government’s stay application is the mere fact that it cannot be bothered to wait for the litigation process to play out before proceed as it wishes.” But, the majority nonetheless is “jettisoning careful judicial decision-making and creating grave privacy risks for millions of Americans in the process.' ”
The Chief Justice seems to defy any reasoned use of fact and law. If in fact any of the alleged waste and fraud had occurred, which is harmful in so much as it might be harmful to law-abiding Americans whose interests under rule of law depend on good faith, honest decisions [not on wasteful or fraudulent choice-making by Americans nor by their government], then it is precisely lawful exercise of government oversight and remedial discovery that is needed while the full protections of every American's private personal and financial information is fully protected.
Robert's written opinion is not anything more nor less than intentional misinformation and rationalization to achieve an outcome, not to achieve justice.
Is Chief Justice Roberts vying to be the worst Chief Justice in American history?
Professor Wehle: An unrelated question - (I apologize if you have addressed this before and if you have, please point me to your answer), but for the first time in my life, I am worried about how to respond if a police officer wants to arrest me without cause. Could you explain in a future post what a US citizen's rights are and how we should respond in that situation? Thank you so much for your work.
Another nonsensical decision from Roberts that will hurt millions of regular Americans
